Eric Holder Contempt Resolution Passes, But Legal Dispute Looms

WASHINGTON -- The Justice Department has declared that Attorney General Eric Holder's decision to withhold information about a bungled gun-tracking operation from Congress does not constitute a crime and he won't be prosecuted for contempt of Congress.

In a letter to House Speaker John Boehner, the department says that it will not bring the congressional contempt citation against Holder to a federal grand jury and that it will take no other action to prosecute the attorney general.

Deputy Attorney General James Cole says the decision is in line with long-standing Justice Department practice across administrations of both political parties.

House Republicans won a historic political fight to hold Attorney General Eric Holder in contempt of Congress, but the GOP probably is still a long way from obtaining documents it wants in an investigation of a bungled Justice Department gun-tracking operation.

There are two routes to enforcing the contempt citations approved by the House on Thursday, a criminal prosecution and a civil lawsuit, although the White House on Friday virtually shut down the criminal path. The civil route through the courts would not be resolved anytime soon.

White House spokesman Jay Carney said Justice Department going back to the administration of President Ronald Reagan has not pursued prosecutions in contempt cases involving assertions of executive privilege.

President Barack Obama invoked a broad form of the privilege to prevent sending department documents to the House Oversight and Government Reform Committee. The chairman, Rep. Darrell Issa, R-Calif., is leading the effort to get the material related to Operation Fast and Furious.

"This is pure politics," Carney said.

"Remarkably the chairman of the committee involved here has asserted that he has no evidence that the attorney general knew of Operation Fast and Furious or did anything but take the right action when he learned of it.

"No evidence, so if you have no evidence as he has stated now about the White House and the attorney general, what else could this be but politics?"

More than 100 Democrats walked out of the House chamber to boycott the first of two contempt votes, saying Republicans were more interested in shameful election-year politics than documents.

Republicans demanded the documents for an ongoing investigation, but their arguments focused more on the need for closure for the family of slain Border Patrol agent Brian Terry. Two guns from the gun-tracking operation were found near his body after a shootout in Arizona.

Democrats promised closure as well, but said a less-partisan Republican investigation was the only way to get it.

Adding to the emotion of the day, the family of the slain agent issued a statement backing the Republicans.

"The Terry family takes no pleasure in the contempt vote against Attorney General Eric Holder. Such a vote should not have been necessary. The Justice Department should have released the documents related to Fast and Furious months ago," the statement said.

It all happened on the day that President Barack Obama's health care law survived in the Supreme Court, prompting some Democrats to speculate that the votes were scheduled to be overwhelmed by news stories about the ruling.

About five hours after the court ruled, with news sites flooded with information about the health care ruling, the House voted 255-67 to declare Holder in criminal contempt.

The matter goes to the U.S. attorney for the District of Columbia, who works under Holder.

A second vote of 258-95 held Holder in civil contempt and authorized the House to file a lawsuit.

In past cases, courts have been reluctant to settle disputes between the executive and legislative branches of government.

The issue became more complicated when Obama invoked a broad form of executive privilege, a legal position that is designed to keep private certain communications of executive branch agencies.

Issa's committee will consult with the House counsel's office about a court challenge to the administration's decision not to cooperate, spokesman Frederick Hill said.

The documents were written after Fast and Furious was shut down. The subpoena covered a 10-month period from February 2011, when the Justice Department denied that guns purchased in the U.S. were allowed to "walk" across the border into Mexico, to early December 2011 when the department acknowledged the earlier assertion was in error.

Republicans said the contempt citations were necessary because Holder refused to hand over documents that could explain why the Obama administration took 10 months to come clean about gun-walking. The operation identified more than 2,000 illicitly purchased weapons. Some 1,400 of them have yet to be recovered in the failed strategy to track the weapons to gun-running rings.

Kinship care is a much messier awkward animal than "standard" foster care, and this is just one of many reasons ...

I am not a big Facebook user, but I do use it to keep in touch with family scattered around. I absolutely do not talk about my nephew's case and have never even mentioned that he's in care, but I do post pics of him sometimes. (Yes, I eventually learned from here that you're not supposed to do this, but since I was never told any of the "rules", technically I don't know this. For all I know DHS would think it's okay since it's kinship. I post pics of my other nephews, too, who are not in care.)

The majority of family unfriended my sister (nephew's mom) before her kids came into care, because of a bad family fall-out. A handful of extended family who have no idea what happened still have her as friends. So I have some "friends" in common with nephew's mom.

I didn't realize that if a friend likes/comments on something you post that friends of the friend can then see the post. Once I learned that I then put all of those "mutual friends" on my restricted list, so that they can no longer see any of my posts or pictures.

However, i recently found out that one of these "mutual friends" is very sympathetic to nephew's mom (obviously doesn't know anything other than what nephew's mom has told her). So because she is also a friend of other friends, she can see stuff that I post if those other friends like/comment on them. Which means she can pass any comments/pictures on to nephew's mom.

Ever since I found that out, I haven't posted anything. I don't really know what to do. Unfriending the "mutual friends" doesn't do any good because many other "friends" have also friended these people. So the same problem applies ... if a friend likes/comments on my stuff then these "friends" of nephew's mom will be able to see it. And I can't ask all of the family to unfriend anyone who's friends with nephew's mom.

Why oh why doesn't have a privacy checkbox that says I ONLY WANT MY STUFF TO BE SHARED WITH PEOPLE I FRIEND AND NO ONE ELSE!!!!! I have gone through the privacy settings many times and don't see any way I can prevent friends of friends from seeing content that my "friend" has liked/commented. Technically I could block the "mutual" friends but then I'd have to keep checking to see if any other "mutual" friends ended up cropping up down the road. We're waiting to hear back on ruling from TPR trial, if TPR is granted then we will adopt and we will definitely want to be sharing more stuff at that point.

I guess my other option is to start using Google Plus instead, but most people don't use it.

Prior to coming to Advanced Prosthetics, I worked full time at Shenandoah Medical Center for 2 years where I treated patients in the hospital, the skilled care facility, the assisted living facility, in their homes for home health, and in the outpatient clinic. I created a Women?s Health practice in Shenandoah, therefore I continue to work there one day a week.

I am at Advanced Prosthetics 4 days a week (Mon, Tue, Thurs, Fri) where I treat patients with orthopedic injuries, balance deficits, gait dysfunction, before and after limb loss, as well as seeing patients with Women?s Health conditions. The Women?s Health conditions I treat include pain/discomfort with pregnancy, bowel and bladder dysfunction, pain syndromes, and post breast cancer.

I completed the CAPP courses through the American Physical Therapy Association Section on Women?s Health in Pelvic Physical Therapy and I will complete my CAPP courses in Obstetric Physical Therapy by spring 2013. I have learned from wonderful Women?s Health physical therapists, Dr. Laura, LaPorta-Krum, PT, DPT and Dr. Cheryl Wisinski, PT, DPT, which significantly impacted my therapy skills.

My undergraduate studies were performed at Nebraska Wesleyan University in Lincoln, Nebraska where I received a Bachelors of Science in Exercise Science with emphasis in Psychology and Religion. I completed my doctoral training at Regis University in Denver, Colorado.

Family tragedy becomes public nightmare when death video hits Twitter

By the time police asked Internet users to remove graphic photos of a man decapitated after he jumped in front of a train, it was too late for the dead man's son. He had already seen the grisly images ? recorded by teenagers?just after the incident occurred ? when they went viral on Twitter.

You can hear the teens in the background of the shaky cellphone video, recorded Wednesday afternoon in the Netherlands, calling to each other in Dutch, their adolescent voices tweaked with shock, excitement. "Here. Here is the body. Here he is," one boy shouts in Dutch. Another points to the man's severed head, a few feet away. No one is laughing.?

At least 70 students?at a nearby school ??in the?Kennemerland area of?Haarlem ??witnessed the accident or immediate aftermath, reports?Ijmuider Courant, a Netherlands news site. School officials swung into action. Within 10 minutes of the incident,?administrators?guided students away from the station and back to the school. There, counselors and members of the?Kennemerland police department spent the afternoon talking to kids and later, their parents, about what they had seen.

Yet at the same time that the school was trying to mitigate the psychological damage of the incident, a video of it was being shared among students and?making its way out onto the Internet, by way of Twitter.

This is the video the?dead man's son had already seen when?Kennemerland?police broke the news to the family. It was then that son connected the two, and realized the video was of his father.?

When the police department found out about the video, the department took to Twitter and asked the public to stop sharing the video. In Dutch, the police?asked, "Anyone who has shared pictures of the?Driehuis?train victim, remove them immediately. It is disrespectful and goes too far!"

It's a good-faith plea, made by a police department savvy in the ways of the Internet, enough to know it was already too late. It was too late 15 minutes after the video first hit Twitter, when the teenage boy who first sent it out into cyberspace deleted his original tweet. It had already been?retweeted countless times. And that is the lesson that Evy Elschot, spokesperson for the Kennemerland police department, hopes people will take away from this incident, instead of the gory details.

"The boy didn't understand the impact of what he had done," Elschot told msnbc.com in a telephone interview. Identifying him only as a teenager between the ages of 14 and 16, Elschot described him choking on tears and shaking with panic when confronted by police. "The boy said he wished he didn't do it, that he could take it back, but of course he couldn't," she said.

The boy tweeted (in Dutch), "I hate myself for what I've done," according to news site RTL.?

Elschot told msnbc.com she regrets the story receiving national attention, resulting in?the inevitable spread of a video that causes pain to a family already suffering. (Msnbc.com will not link to the video.) To protect the family's privacy, she would not share the age of the son who saw his father in the video.?

According to?Elschot, it was a very difficult decision to ask people via Twitter to delete the video.

The Kennemerland police department is very active on Twitter, using the official account to communicate with the public on such things as traffic delays, especially crowded areas at festivals, as well as finding witnesses to crimes and fielding complaints (and compliments) from the public. But by using Twitter to discuss a suicide, the Kennemerland police department went against what Elschot describes as Holland's "gentleman's agreement" to not publicize details about suicides.

Elschot said that it's in consideration for families whose?members?commit suicide,?but this practice also abides by the World Health Organization's recommendations for avoiding suicide contagion ? a phenomenon which affects those already at risk. Train suicides account for 4 to 10 percent of suicides in the Netherlands, the Journal of Affective Disorders reported in 2010.??Such a video going viral could spread contagion as well.

Elschot agrees that there's an important discussion to be had, but not about this family's tragedy.

"This really is about young people and how the world is different," she said. "When I was a kid, I might say some things in my small town without thinking, but we only had the telephone. Someone else might read your letter, and there is embarrassment for awhile, but not the oil spread of information we now have on the Internet. Kids need to understand that and their parents need to tell them."

The American Library Association website offers a variety of resources to help parents and kids navigate the Internet safely and responsibly. ?

Gatorland: Exotic-pet amnesty day set for May 19 ? IRadioIsrael.com

Gatorland and the Florida Wildlife Commission will hold a non-native pet amnesty day at the longtime attraction in south Orlando on May 19.

The animals can be surrendered to the commission with no questions asked and no penalties. Non-native reptiles, amphibians, birds, fish, mammals and invertebrates will be accepted, but domestic pets such as dogs, cats and ferrets will not be accepted.

Snoop Dogg busted in Norway with marijuana, cash

(AP) ? Norwegian media are reporting that Snoop Dogg was briefly detained in Norway after entering the country with marijuana and a large amount of cash.

Customs officials decline to confirm the report, saying only that an American artist entered Norway with a small amount of marijuana that was detected by a sniffer-dog. Norwegian law prevents law enforcement officials from naming suspects.

A customs officer who spoke on condition of anonymity said Thursday that the artist was also carrying more cash than is legally allowed and was subsequently fined 52,000 kroner ($8,600) for the violations.

Snoop Dogg was scheduled to perform Thursday at a musical festival in the southern town of Kristiansand.

The rapper, whose name is Calvin Broadus, has in the past been arrested on marijuana possession.

Under the Justice Department's COPS (Community Oriented Policing Services) program, 629 of the 800 police jobs funded for the next three years must go to veterans who served at least 180 days' active duty since 9/11. This is the first time the 18-year-old COPS program has required cities and counties seeking grants to partner with military agencies to advance veteran employment.

Recent vets face high unemployment rates, and Vice President Joe Biden said Monday that this initiative is part of the Obama administration's effort to try to help them transition to civilian life.?

"We don?t think if they fought like hell over there they should have to fight as hard [to find a job] when they get back home,? Mr. Biden said on a press conference call, after Attorney General Eric Holder announced the new COPS requirement in Philadelphia.

In his State of the Union message in January, President Obama declared that employment for military veterans would be a priority for his administration. But joblessness remains a stubborn problem. ??

Unemployment among recent veterans jumped to 12.7 percent in May, up from 9.2 percent the previous month, according to the US Bureau of Labor Statistics. The Veterans Affairs blog notes that this number jumps up and down but is trending downward overall.

As was expected, Summit announced that "Breaking Dawn - Part 2" will once again take San Diego Comic-Con by storm. As many of us remember fondly, Hall H was the site of the franchise's first-ever Comic-Con appearance back in 2008, when thousands of excited fans made the pilgrimage to San Diego to see the cast assembled together for the first time. No word yet on which castmembers will be making the trip to the Con, but because it's in support of their last "Twilight" movie, we're betting on seeing most, if not all, of our favorites.

ScienceDaily (June 25, 2012) ? Cholesterol-lowering statin drugs appear to be associated with reduced risk of recurrent cardiovascular events in men and women, but do not appear to be associated with reduced all-cause mortality or stroke in women, according to a report of a meta-analysis published June 25 in the Archives of Internal Medicine, a JAMA Network publication.

Statins have been used to lower cholesterol levels for the last 20 years, but most of the clinical trials on the drugs have predominantly enrolled men. There have been conflicting results on the benefits of statins for women with cardiovascular disease compared with men in secondary cardiovascular disease prevention, according to the study background.

Jose Gutierrez, M.D., M.P.H., of Columbia University Medical Center, New York, and colleagues conducted a meta-analysis of 11 clinical trials (a total of 43,191 participants) to examine whether statin therapy was more effective than placebo in preventing recurrence of cardiovascular events and all-cause mortality in men and women. Researchers also sought to determine the sex-specific effect of statins on the risk of recurrent cardiac and cerebrovascular events.

"In our results, statin therapy reduced the recurrence rate of any type of cardiovascular event, all-cause mortality, coronary death, any MI [myocardial infarction or heart attack], cardiac intervention, and any stroke type. The stratification by sex showed no statistically significant risk reduction for women taking statins compared with women taking placebo for the reduction of all-cause mortality and any type of stroke," the authors comment.

However, the authors observe that the results of their meta-analysis "underscore" the low rate of women being enrolled in cardiovascular prevention clinical trials.

"Women represented only a fifth of the studied sample, limiting the strength of our conclusions. In our results, the benefit associated with statin administration in women did not reach statistical significance compared with placebo in at least two outcomes, all-causes mortality and any stroke type. The reason for this difference is uncertain. One possibility is that the small sample size of women limits the power of the study," the authors note.

The authors conclude "this meta-analysis supports the use of statins in women for the secondary prevention of cardiovascular events."

Colwill win 3-meter; Viola wins 10-meter at trials

With his Olympic hopes on the line and a sliver of a lead, Colwill's final dive of the U.S. Olympic trials men's 3-meter springboard finals Sunday was the highest scoring dive of the entire competition.

Colwill rallied from third place to win the men's 3-meter springboard, while Dumais held off Ipsen in the final round to finish second and reach his fourth Olympics in the event.

"Competing in the Olympics that definitely was the biggest pressure, but I felt like I did a good job and enjoy myself and have fun and not worry so much about how the event was going to go and embrace the environment," Colwill said.

The other final on Sunday saw Brittany Viola, daughter of 1988 Cy Young Award winning pitcher Frank Viola, win the women's 10-meter platform in her third attempt to make the Olympics.

Viola dominated the competition winning by nearly 60 points ahead of second place Katie Bell, who claimed the other qualifying spot for the London games. Viola scored 86.40 on her second-round dive, an armstand back dive from the platform with 2 somersaults and 1 1/2 twists, getting all 9s from the judges.

"A greater perspective that this is just another meet," Viola said of her previous trials experiences. "Although there are a lot of lights and colors and Olympic rings everywhere it comes down to the diver and the platform and that's something Katie and I can take into the Olympics."

Colwill was third after the preliminaries and third after the semifinals, positions that would have left him on the outside of Olympics if the final held to form. He scored at least 74 points on all six of his dives and qualified for his second Olympics in the event. Colwill finished 12th at the 2008 Olympics in Beijing.

Ipsen and Dumais were already headed to London together as the U.S. representative in the synchronized 3-meter springboard competition. For Dumais, it will be his fourth trip, tying Greg Louganis as the only American men to make four Olympic diving teams.

Entering the final round, the three divers were separated by a mere 2.40 points and all three had their favorite dives for their finale. Colwill scored 99.75, the highest of the competition, on a reverse 3 1/2 somersaults on his final dive that because of a higher degree-of-difficulty than the other two, all but clinched the title.

Dumais moved his signature dive, a forward 2 1/2 somersaults with 2 twists pike, to the final round believing the event could come down to the last dive. The decision was a wise one, with Dumais scoring 91.80 and forcing Ispen to score 93.05 on his final dive to tie. Ipsen's final dive was excellent ? a reverse 1 1/2 with 3 1/2 twists ? but the 91.80 wasn't enough to overcome Duamis' lead for the second Olympic spot.

Ipsen thought initially it was going to be enough.

"I thought I had made it," Ipsen said.

Ipsen led throughout the entire competition until the fifth-round when his reverse 3 1/2 somersaults came up well short and scored just 47.25 points. His entire lead, which had been slightly chipped in to by both Dumais and Colwill, was gone and an audible gasp came from the crowd when the scoreboard showed Ipsen now in third place.

What appeared to be a competition between Colwill and Dumais for the final qualifying spot suddenly became a three-way race for two trips to London.

"I knew this was going to be a nail-biter. I knew it was and that's why I switched my list ... knowing it was going to come down to the last dive," Dumais said. "... I would rather put pressure on a dive that I knew I was capable of doing and luckily it panned out. I knew how to do my last dive."

For Viola, this was her third Olympic trials and she barely missed a trip to Beijing finishing fourth in 2008. She held a comfortable lead going into the finals and never had her Olympic spot threatened. After her 86-point dive in the second round, Viola slipped in the third and fourth rounds, scoring just 43.50 on a back 2 ? somersault pike in the fourth round. But her final dive, a back 2 1/2 somersault pike with 1 1/2 twists, scored 80.00 and clinched the title.

Viola's dad wasn't able to get away from his job as pitching coach for the Savannah Sand Gnats, the New York Mets' Single-A affiliate, to attend the trials, but told his daughter he would be watching on a clubhouse television today and likely not doing much coaching.

"I know that he is watching every moment," Viola said.

Bell, who stands just 4-foot-11, had Haley Ishimatsu right behind her entering the fourth round, but Ishimatsu missed on her dive and scored just 29.70. It gave Bell enough of a comfortable cushion headed to the final round.

"It's unreal," Bell said. "I was nervous. I knew that I needed to be consistent and dive the way that I had been in practice."

AMES, Iowa -- In traditional electrical lines, a significant amount of energy is lost while the energy travels from its source to homes and businesses due to resistance. Superconductors, materials that when cooled have zero electric resistance, have the promise of someday increasing the efficiency of power distribution, but more must still be learned about superconductors before they can be widely used for that purpose.

Scientists at the U.S. Department of Energy's Ames Laboratory are using specialized techniques to help unravel the mysteries of a new type superconductor that was discovered in 2008. Ames Lab physicists were part of an international collaboration that also included scientists at Kyoto University in Japan, University of Illinois at Urbana-Champaign and University of Bristol in the United Kingdom to study the materials.

The group found that magnetism may be helping or even responsible for superconductivity in iron-based superconductors. The results were published in the June 22 issue of Science.

"The first step in designing superconductors for new technologies that will help save energy is better understanding of how superconductors work," says Ruslan Prozorov, who led the team at Ames Lab that also included Kiyul Cho and Makariy Tanatar.

Unfortunately, most conventional measurements of material parameters, such as resistivity, aren't useful in the state of superconductivity. But Prozorov several years ago helped developed a technique to measure how far the magnetic field penetrates into a superconductor. This length is called the London penetration depth, and it reveals basic information about a material, even in the superconducting state.

"London penetration depth is one of the few quantities we can measure in a superconducting state to learn more about what's going on, so the technique we specialize in here at Ames Laboratory was particularly useful for this research project," said Prozorov, who is also an associate professor of physics and astronomy at Iowa State University. "In this collaboration, we studied a barium-iron-arsenic-phosphorus material at near zero Kelvin, and our London penetration depth measurements suggested that magnetism is responsible for superconductivity in iron-based superconductors. Typically, magnetism is detrimental to superconductivity, but when it is weakened enough, it might actually be helping."

The international team's research helps answer one of the central questions about how iron-based superconductors work.

"Iron-based superconductors may open the door to new energy technologies," said Prozorov. "But we'll only get there through materials science and understanding the mechanism of superconductivity in these new iron-based materials."

Many people shy away from kitchen remodeling projects because they don't want to spend an arm and a leg. For instance, one of the first things people desire to change during a kitchen remodeling project is their cabinetry. So, they go out to their local home improvement store to make their choice. If they are on a budget, they pick out the cheapest one that they can find. They hire a specialist to come in and install them and a week later they regret their choice. The regret comes in because they just didn't have the money to get the look that they truly desired. However, what they didn't realize is that these days, people don't necessarily have to change out their cabinets completely in order to get an updated look. All they really need is paint. For example, if they want a mahogany wooden look, all they have to do is tell their contractor and they will be able to locate a paint color that matches the look almost exactly.

Another thing that some people think has to be expensive is countertops. However, it doesn't have to be so. Faux stone or granite counters, for instance, present the same look at a fraction of the price. So instead of having a contractor come in and install real stone or granite, they could install the less expensive alternative instead. This way the homeowner and the building specialist will be happy. That's because the owner won't have to be thinking about how much money they spent and the contractor won't have to skimp on other areas of the project because of a rapidly depleting budget.

Lastly, there is also a cheaper flooring alternative that can be installed during a kitchen-remodeling project. One of the most popular types of flooring choices these days is ceramic tile. So, it's no surprise that people are quick to choose this floor type when it comes to his or her eating space. However, for those on a smaller budget, they can opt for the laminate flooring instead of the actual ceramic tile. Although it may not be authentic, this type of floor gives off the same look and high-class style.

So, a kitchen remodeling project doesn't have to be super expensive. All someone has to do is find effective alternatives.

  • Playacar Golf Club
    This 18-hole, par 72 championship golf course designed by Robert Von Hagge, is carved through the lush Mayan jungle. A driving range and putting green is available. Rental clubs are available for $30 USD. There is a $90 USD twilight rate (after 2 pm).

  • Hilton Park Golf Club
    This 18-hole (par 72) championship course is definitely the selling point for the Hilton Cancun Beach and Golf Resort. Robert Trent Jr. designed the course, incorporating one Cancun's ruins (Ruinas Del Ray) into the grounds. There are some challenging sand traps and an excellent driving range along with a lovely view of the lagoon. The sunsets are especially beautiful. Open 6:00 AM to 6:00 PM. Pull carts are prohibited.   • Puerto Aventuras
    Marina, tennis / golf club. Features a par 36, 9-hole course designed by Thomas Leeman. Maximum length 3,236 yards. Also, features a putting green. $45 USD (unlimited holes). Rental clubs / carts are available. Located on the Cancun to Chetumal highway at km. 90 Puerto Aventuras, Playa del Carmen, Q.ROO.

    Located in Cancun???s Hotel Zone and designed by Robert Trent Jones Jr., this 18-hole, par 72 golf course is 6,636 yards long. Features a practice tee, putting green, oceanfront holes and Mayan Ruins. $90 USD. $45 USD twilight rate.
